Terms of Use — Sarasa

Effective date: 12 October 2026

These Terms of Use ("Terms") govern your use of the Sarasa app for Android ("the App"), provided by Xcool Private Limited ("we", "us", "our"). By installing or using the App you agree to these Terms and to our Privacy Policy (https://xcool.in/sarasa_privacy_policy). If you do not agree, please do not use the App.

1. Who may use the App

You may use the App if you are 18 or older, or if a parent or guardian has agreed to these Terms on your behalf and supervises your use. A parent or guardian who allows a learner to use the App is responsible for that use.

2. What the App is

The App is a practice aid for Indian classical music: accompaniment and a live pitch display of what you sing. It does not replace a teacher.

Pitch readings are estimates produced on your phone and can be affected by your device, room, microphone and accompaniment volume; we do not guarantee any particular accuracy or result from practising with the App.

3. Your licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for your own practice and teaching. All rights not expressly granted are reserved.

4. Acceptable use

You agree not to:

  • copy, modify, distribute, sell or lease the App or any part of it;
  • reverse engineer, decompile or disassemble the App, or try to extract its source code, models or audio samples, except where the law expressly allows it;
  • interfere with, overload or attempt to gain unauthorised access to our servers or other users' data, or send us false or automated data;
  • remove or obscure any notices of ownership in the App;
  • use the App in breach of any applicable law.

5. Payments

Some features of the App may require a subscription or another purchase.

  • Purchases are made through Google Play and are processed by Google under Google's terms. We never receive your card or bank details.
  • The price, taxes and any free-trial terms shown in Google Play when you confirm a purchase apply.
  • Subscriptions renew automatically until you cancel them in the Google Play app. If you start a free trial, you will be charged when it ends unless you cancel before then.
  • Refunds are handled under Google Play's refund policy. Where the law requires a refund, we will honour it.
  • These Terms apply in full whether you use the App free of charge or have paid for it.

6. Your data

How we handle data is described in the Privacy Policy, which forms part of these Terms. In short: practice-data sharing is optional and off until you agree; automatic problem reports (crash and error logs, no audio) help us fix bugs and can be switched off in Settings; you can delete your shared data at any time in the App.

7. Our content and intellectual property

The App, including its software, design, audio samples, rhythm patterns, models and text, is owned by us or our licensors and is protected by copyright and other laws. Some sounds and patterns are licensed from third parties and are provided only for use inside the App.

8. Feedback

If you send us feedback or suggestions, we may use them without obligation to you.

9. Availability and changes

We may update, change or discontinue features of the App. We try to keep the App working reliably but do not promise that it will be uninterrupted or error-free. Updates may be required to keep using the App.

10. Ending your use

You can stop using the App at any time by uninstalling it; cancel any subscription in Google Play separately. We may suspend or end your licence if you seriously or repeatedly break these Terms. Sections 4, 7, 11, 12 and 14 continue to apply after your licence ends.

11. No warranty

The App is provided "as is" and "as available". To the fullest extent permitted by law, we make no promises or warranties of any kind, express or implied, about the App, including that it will be accurate, reliable, uninterrupted, free of errors, or fit for any particular purpose. You use the App at your own risk.

12. No liability

To the fullest extent permitted by law, neither Xcool Private Limited nor its directors, employees or partners are liable to you or to anyone else for any loss or damage of any kind, whether direct, indirect, incidental, special or consequential, and however caused, arising out of or in connection with the App or these Terms. This includes, for example, loss of data, loss of practice progress, device problems, or any decision or result based on the App's pitch readings.

If, despite this, we are found liable for any loss, our total liability for all claims together is limited to the amount you paid us for the App in the 12 months before the claim arose. If you have not paid us anything, that amount is zero.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.

13. Changes to these Terms

We may update these Terms. If a change is material, we will update the effective date above and, where appropriate, tell you in the App. Continuing to use the App after a change takes effect means you accept the updated Terms.

14. Governing law and disputes

These Terms are governed by the laws of India. The courts in Maharashtra, India, have exclusive jurisdiction, subject to any rights you have as a consumer to bring proceedings where you live.
